Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use PinGrow. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using PinGrow on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

PinGrow provides the following features:

• Pinterest integration: Connect your Pinterest account via OAuth to manage boards and pins.
• Pin creation & scheduling: Create pin drafts with images, titles, descriptions, and hashtags, then schedule them for automatic publishing to your Pinterest boards.
• AI caption generation: Generate SEO-optimized pin titles, descriptions, hashtags, and board suggestions using artificial intelligence.
• Analytics: View performance metrics (impressions, saves, clicks) for your published pins.
• Board management: Sync and manage your Pinterest boards within PinGrow.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Account and Access

To use PinGrow, you must authenticate with a valid Pinterest account. You are responsible for:

• Maintaining the security of your Pinterest account credentials.
• All activity that occurs through PinGrow under your account.
• Ensuring that your use of PinGrow complies with Pinterest's own Terms of Service and Acceptable Use Policy.

You may revoke PinGrow's access to your Pinterest account at any time through your Pinterest security settings.

4. Your Content

4.1 Ownership

You retain full ownership of all content you upload to or create through PinGrow, including images, text, titles, descriptions, and any other materials (“Your Content”). We do not claim ownership of Your Content.

4.2 License to Us

By uploading content to PinGrow, you grant us a limited, non-exclusive, worldwide license to store, process, and transmit Your Content solely for the purpose of providing the Service to you (e.g., storing images for scheduling, sending content to Pinterest for publishing, and sending images/text to our AI provider for caption generation). This license terminates when you delete Your Content or your account.

4.3 Your Responsibilities

You are solely responsible for ensuring that:

• You have the right to upload and publish Your Content.
• Your Content does not infringe on the intellectual property rights of any third party.
• Your Content complies with Pinterest's content policies and all applicable laws.
• Your Content does not contain illegal, harmful, abusive, or objectionable material.

5. AI-Generated Content

PinGrow uses artificial intelligence (currently Google Gemini) to generate pin captions, including titles, descriptions, hashtags, and board suggestions.

• No guarantee of accuracy: AI-generated content is provided as suggestions only. It may contain errors, inaccuracies, or content that does not match your intent. You are responsible for reviewing and editing all AI-generated content before publishing.
• No guarantee of originality: AI-generated content may be similar to content generated for other users or to existing content on the internet. We do not guarantee that AI-generated content is unique or free from similarities to other works.
• Your responsibility: Once you accept, edit, or publish AI-generated content, it becomes Your Content and you assume full responsibility for it.
• No endorsement: AI-generated suggestions (including board suggestions) are algorithmic recommendations, not endorsements or professional advice.

6. Acceptable Use

You agree not to use PinGrow to:

• Violate any applicable law, regulation, or Pinterest's policies.
• Upload or publish spam, misleading content, or content designed to artificially manipulate Pinterest's algorithms.
• Infringe on the intellectual property or privacy rights of others.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use automated tools or scripts to interact with the Service in a way that exceeds normal usage patterns or circumvents rate limits.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or provide the Service to third parties without our written consent.

We reserve the right to suspend or terminate your access if you violate these terms.

7. Pinterest Platform Compliance

PinGrow operates as a third-party tool built on the Pinterest API. Your use of PinGrow is subject to Pinterest's developer terms and policies. In the event of a conflict between these Terms and Pinterest's terms, Pinterest's terms govern your use of the Pinterest platform.

We are not affiliated with, endorsed by, or sponsored by Pinterest, Inc. “Pinterest” is a trademark of Pinterest, Inc.

8. Service Availability and Scheduling

We strive to keep PinGrow available and reliable, but we do not guarantee uninterrupted service. Specifically:

• Scheduled pins: We make reasonable efforts to publish your scheduled pins at the designated times. However, we cannot guarantee exact timing due to factors such as server load, Pinterest API availability, rate limits, or network issues.
• Failed publishes: If a pin fails to publish, our system will automatically retry up to 3 times. If all retries fail, the pin will be marked as failed and you will need to take manual action.
• Downtime: The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Intellectual Property

The Service, including its design, code, features, and branding (excluding Your Content), is owned by PinGrow and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR NEEDS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINGROW AND ITS OWNERS, OPERATORS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless PinGrow and its owners, operators, and contributors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the Service.
• Your Content, including any claims of infringement.
• Your violation of these Terms or any applicable law.
• Your violation of Pinterest's terms or policies while using PinGrow.

13. Termination

You may stop using PinGrow at any time by signing out and revoking our access through your Pinterest security settings. You may also request account deletion by contacting us.

We may suspend or terminate your access to the Service at any time, for any reason, including but not limited to violation of these Terms, abuse of the Service, or inactivity. Upon termination, your right to use the Service ceases immediately.

Sections 4 (Your Content), 5 (AI-Generated Content), 10 (Disclaimer), 11 (Limitation of Liability), and 12 (Indemnification) survive termination of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top of this page. We encourage you to review these Terms periodically. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PinGrow regarding the Service and supersede all prior agreements and understandings.
